This is Lance Heiskell at FUNimation Entertainent. We can confirm that FUNimation Entertainment has obtained an agreement authorizing FUNimation to act on behalf of d-rights to prevent infringement on specific titles.

The authorization agreement for d-rights is for 5 series in total:
Monochrome Factor
Nabari no Ou
Kateikyoushi Hitman Reborn
Bamboo Blade
El Cazador de la Bruja

Though these series have not been licensed to a local distributor in North America, it is important to note that the rights owned by Japanese producers are still applicable, and enforceable, worldwide.

One behalf of d-rights, please drop Nabari no Ou and remove all torrents from http://tracker.anirena.com/ other torrent tracker sites and your irc channel.

Japan’s creators can at any time go sue you even if it’s unlicensed but the odds of them tracking you down, throwing down a bilingual lawyer to wherever you live and trying to sue you, a poor otaku SOB, is not worth it, especially since someone else will just pickup your work.

    Retarded companies just think they can throw threatening letters now with no merit and get people to quit, and shamefully its working.

    You know, Bob Dole is absolutely spot on. Since Lance Heiskell is not legally involved then nothing will happen if Rumi (or anyone else) continue to sub the series. And also, Bob Dole is right about the Japanese creators too; the chances of them actually bothering to track you down are around 0.6% if you ask me.
    And as for the .ass formats… I don’t think there’s anything wrong with those. Should Rumi want to continue writing these .ass files with a certain script for a certain awesome series inside, then I’m sure someone *me* would be more than happy to put the two together.

    FUNIMATION has the legal authority to act on behalf of the creators as they’ve signed an agreement on the matter. That being said, Nabari no Ou better get licensed or I won’t be too happy myself.

    As for releasing .ass files I suspect that they’d still infringe on the creator’s rights, but that until licensed FUNIMATION might (depending on the agreement that they signed) not be able to personally do anything.

    However, it’s probably not worth the effort anyway. Also, those waiting on a certain other group probably shouldn’t hold their breath as they probably received the C&D as well and just haven’t seen it yet.

    My point was that Lance Heiskell, on behalf of FUNimation, actually does have the rights to tell people to stop and that depending on the agreement that FUNimation signed with d-rights, FUNimation might have the legal ability to take it to court even if they haven’t licensed it.

    Not that it matters too much. So long as it gets licensed and released with decent speed and quality I’ll be happy to take my money and support the industry.

He is not distributing those titles nor is he working for the content creator. He is not a lawyer and cannot represent them in court. He’s not making money off the series yet so he can’t sue you for damages.

    He is useless. In Otakon he faggotted a list of 94 that pirate anime on the internet, and to the crowds shock and horrid boredom proceeded to read half of them.     Also, I agree tiggi there. Rumi should just keep doing what they do since if there’s one thing we can all agree on it’s that Rumi does good work.

The fact of the matter is Lance Heiskell isn’t just some corporate tool from funimation who decided he wanted to take on himself the responsibility of C&D fansubs of ongoing series, the Japanese license holders made an agreement with the company he works for to ensure that people stop fansubbing the series they work hard on to feed their families. That’s right, the creators of the show you love so much are the ones asking that people stop subbing and Lance is simply the messenger, ever heard the old saying “don’t shoot the messenger”? In other words your anger is misplaced, if you wanna be mad be mad at the ones who asked funimation to issue the C&D’s.

    Second of all, no the Japanese people would waste far too much money to track down individual fansubers on the other side of the globe, which is the reason why they’ve focused on reprimanding the raw providers in their own country thus essentially killing the root of the problem.

    Anyway I digress, thanks rumi for all your hard work, I really did enjoy all your releases of Nabari and will keep my eye on your group for release of other series I may show interest in the future. I’ll be sure to pick of the series where it left off when ever it may be licensed here.

If Lance was as bitter as you say he was then why even attend the otakon panel about fansubs and the industry at all? Why not just skip it and then curse the fansubers out at the state of the industry panel instead?

    I did see the ann video of the fansubxindustry panel and upon watching that and reading your statements I wonder if you and I even watched the same video? Say what you want about corporate execs “bullying” people who are doing illegal things from continuing to do so, but unless you missed the fansubbers response on that topic all of them were in the common concensus that if sent such a letter they would comply under the understanding that these companies are simply protecting their property.

    Japan, licensors, and fansubbers all recognize the system. It’s a common policy amongst fansubbers to stop when asked for whatever reason as ultimately it’s always for the sake of the creators that fansubbers do stop.

    As a note, I’m a fansubber myself and can assure you that most fansubbers will stop on a C&D even if it can’t be enforced. There’s a reason why Rumi dropped the project and if you can’t figure out why it’s your own fault and problem. You shouldn’t blame it on anyone else. You need to realize that this world does not exist for you, for Lance, or even for the creators of the anime you watch. What happens happens so live with it!

    The C&D encompasses everything. Video, subtitles, and actually even Anime Music Videos. Releasing anything related to the series is infringing on the creator’s rights. Funimation has the right to send out these C&D by the creator which also means, if they catch me doing anything related, they can track me down and sue my silly ass; or even worst, the Canadian Government would be involved. Funimation has an operation in Canada; therefore it would be unwise of me to do so.

    To those who think I’m being a lazy ass or hate me for dropping, I’m sorry I’m hurting your feelings, but you’ll have to live with the fact I’ve dropped it. I will not, and will never try anything that would provoke any studio or R1 production company.

    As someone said above, I do this out of pure pleasure to helping those who I can, and however far I can help as time permits.

    Well, maybe Rumi is not aware of the fact that receiving a C&D does not mean that Funimation (or anyone else) has started monitoring you in every possible way.

    There are some simple ways to go on subbing anonymously, and I would gladly explain them. Doing that here is not really safe, so I’ll just start giving a hint: the word “Syndicate” should ring a few bells.

    I very much understand they do not monitor my actions, they do however monitor the releases through torrent sites and direct download sites, most probably with search bots. Should they find that “Rumi Productions” is still releasing I will without a doubt be held responsible. A simple call to the Canadian Government would put “Rumi” in a lot of trouble.     But.. one bad news after another: first that you were forced to drop the project *sob* and now.. I just checked youtube for the new, 21st raw episode, and yeah, there is first part of it REMOVED due to a copyright claim by the third party *faints* Which means - no NnO this week.
    The funny thing is, all episodes with spanish subtitles are still available to watch.
    I`m depressed now. NnO is still being aired, is not even licensed and I don`t even know when -or if ever - will be. I live in UK now, I could buy it, but when I`ll come back to my country, I`ll have NO chance to get it. I know I sound stupid and whiny, but.. me and my friends always dl subbed anime *blushes* and if we like it - we buy manga or anime as soon as it`s being released in English (and we have someone in UK, France or Germany who has access to the manga stores, like me at the moment^^).

It’s just that… the C&D letter that you received is BULLSHIT, they haven’t licensed it so they have no rights to stop ANYONE who subs or dubs it UNTIL they license it and we “leechers” feel left behind cuz we “leechers” are expecting more episodes from this awesome anime. You know, the kinda kid who was hated in school by the geeks and so the industry is his escape for revenge on all those who never invited him to lan parties, but thats what i see
